Prerogative Court of Canterbury Wills



Wills were generally 'proved' according to where the person held land. If the land lay entirely within one archdeaconry (a group of parishes formed a 'deanery' and a group of deaneries formed an 'archdeaconry'), the will was heard in that archdeacon's court. However, if a person held land in more than one archdeaconry, then a bishop (of a diocese) would have jurisdiction. If a person held land in more than one diocese, than the will would be proven in either the Prerogative Court of York (PCY - for the north of England) or the Prerogative Court of Canterbury (PCC - for the south). Some people however, especially the wealthy, liked to have their will proven in a higher court than really necessary and this became quite fashionable after 1800.

John Lovelock 1658

In the name of God Amen. The two and twenty day of May in the yeare of our Lord God, one thousand six hundred fifty eight. I John Lovelocke the elder of Warmister in the county of Wilts Blackesmith being sicke and weake in body but sound and perfect memory thankes I render to God for the same doe make this my last Will and Testament in manner and forme following. First I give all my shopp of tooles unto my sone Nathaniel Lovelocke, and three pounds of lawfull English money, and all my estate, terme of yeares, claime, and demands of, in, and to six acres of arable land more or lesse which I lately bought of George Smart and one coffer. Alsoe I give unto my three daughters the summe of foure pounds a peice of lyke lawfull money. Item I give unto my daughter Weirrable my last wives gold ring, my least brasse pott, and two of my best barrells, and one canvas sheete. And all the rest of my linnen equally betwixt my other(?) three daughters. Alsoe, I give unto my daughter Anne my chest(?), and the gold ring that was her owne mothers ring. Alsoe, I give unto my daughter Mary one blanckett, and one flockbed(?). I give unto my said(?) daughter Anne the coverlett which belongs to my bed whereon I lodge, and one flockbed(?). Alsoe, I give unto my sonne Nathaniell my truckle(?) bedstead, and all the bedding belonging to the same. All there __ of mine estate I give wholy, and intirely unto my sonne John Lovelocke whom I constitute and appoint the whole and sole Executor of this my last Will, and Testament which I rectify and confirme revoking hereby all former, and other wills by mee made whatsoever. In witnes whereof I have hereunto sett miye hand, and seale the day, and yeare first abovewritten. The marke of John Lovelocke senr. This Will was proved at London, the nine and twentyth day of November, one thousand six hunded and fifty eight, before the Judges for Probate of Wills pc(?) by the oath of John Lovelocke the sone sole Executor pc.(?) Towson(?) Adcon(?) pc.(?) was comitted, he being first by Comission sworne truely to Adminster pc.(?)

Edward Lovelock 1659

Memorandum that about the yeare of our lord one thousand, sixe hundred and ffifty Edward Lovelocke of Woolston, in the Countie of Berk(shire), yeoman, made his last will, and testament in writing, and thereby gave the lease of his Mill, and the land thereto belonging to Elizabeth his wife, for so many year of the terme(?) thereof as she should live. And the remainder of his said lease he gave to Thomas Lovelock his sonne. And his other lease he gave in manner following (that is to say) as for one halfe thereof he gave to his said wife so longe as she should live a widowe for and _____ his name(?) in bringing by his younger children. And after her death or marriage whereof should first happen. Then he gave the same to his said sonne for the remainder of his terms of his said lease. And as for the other halfe thereof he gave the same to his said sonne for the whole remainder of his said lease. And he gave to his sixe daughters tenn pounds a piece to be paid at their respective ages of twenty and two yeares. And as for the one Boxe of lynnen which stood under his bed he then lay on he gave the same to his said wife. And all other his house hold stuffe he desired his wife should have the use thereof during her life. And after the same should remaine to his said sonne. And made his said wife Executrix. In the presense of us whole names are under written. Thomas Saunders, Jo: Saunders, Byron Eaton.

The will was proved at London before the Judges for probate of wills and granting Administracone the second daye of April in the yeare of our lord one thousand sixe hundred ffiftie and nyne. By the oath of Elizabeth Lovelock his reliecte and sole Executrix named in the said will. To whom Administracon of all and singular(?) the goods, chattells and debts of the said Edward Lovelocke abovesaid was comitted and granted. She being first sworne by comisrion(?), well and truely to administer the same.

Edward Lovelock 1780

In the name of God Amen. I Edward Lovelock of Newtown in the parish of Hungerford in the County of Berk(shire) Gentleman being by the goodness of God of sound and disposing mind memory and understanding do write and declare my last will and testament in manner following (that is to say my will and desire is that all and singular my just debts funeral and testamentary charges and expenses are duly paid and satisfied as soon after my decease as conveniently may be and whereas I have paid or desired to be paid the sum of ten thousand pounds as a portion upon the marriage of my daughter Ann with one James Butler of Lincoln(?) I do therefore give unto my said daughter Ann five pounds only to buy her mourning. Then I give to my daughter Elizabeth Lovelock the sum of one thousand pounds to be paid to her in twelve months next after my decease. Item I give to my beloved wife Ann Lovelock one annuity or ___ rents charge of twenty pounds of careful ___ of Great Britain to be issuing and payable to her my said wife and her assigns during her natural life out of and from my freehold messuages or tenements lands and hereditaments in the parish of Chipping Lambourne in the county of Berks and in Newtown aforesaid hereinafter devised to my son Francis Lovelock and his heirs and also any other annuity or near yearly rent charge of forty pounds of like lawfull money to be ___ and payable to my said wife and her assigns during her natural life out of and from my freehold __ messuages lands tenements tythes and hereditaments _ late at Hidden in the said parish of Hungerford and at Newtown aforesaid hereinafter devised to my son Edward Lovelock and his heirs which said ____ annuities of twenty pounds and forty pounds my will is shall be respectively paid and payables to my said wife and her assigns during her life as __ aforesaid by half yearly even payments on two of the most usual feasts or days of payment of rent in the year that is to say the feasts of the annunciation of the blessed Virgin Mary and Saint Michael the Archangel the first payment thereof respectively to begin and be made on each of the said feast days as shall first and next happen after my decease and my will and meaning is that in case the said respective annuity of twenty pounds and forty pounds or any part thereof respectively shall be ____ and unpaid in part or in __ by the space of thirty days next over or after either of the said feasts or days of payments whereon the same ought to be respectively paid as aforesaid then and so often it shall and may be lawful to and for my said wife or her assigns into and upon the said respective messuages lands tenements and hereditaments and premises hereby respectively charged with the payment of the same as aforesaid or any part thereof respectively to enter and entrain for the same and the distress and distresses then and there found to take lead drive carry away and impound to detain and keep until the annuity or yearly rent charge so unpaid and all arrears thereof and all costs charges and expenses in taking such distress and distresses shall be fully satisfied and paid and in default of payment in one time after any such distress or distresses shall be so taken to appraise sell and dispose of the said distress or distresses or otherwise to demean therein according to law to the end and intent that thereby the said respective annuity and all arrears thereof and all damages to be sustained by reason of the unpayment thereof respectively. And all costs charges and expenses attending the recovery thereof shall be fully satisfied and paid and my will and intention is that if it shall happen that the said respective annuities or yearly rents charge of twenty pounds and forty pounds or any part thereof respectively ___ behind or unpaid in part or in all ___ spare ____ ____ next over or after either of the said feasts or days of payment hereinbefore mentioned and appointed for the payment thereof respectively then and so often and from time to time as it shall so happen although no formal demands shall be made. It shall and may be lawful to and for my said wife or her assigns into and upon the said respective messuages lands tenements hereditaments and premises so respectively charged with the payment thereof as aforesaid or into or upon any part thereof respectively to enter and the rents ___ and profits thereof respectively to have receive and take to her and their own use and benefit until thereby or therewith or otherwise all arrear of the annuitys or yearly rents charge respectively then grown one or that during such possession shall grow one and all costs charges and expenses attending such entry upon and perception of the rents and profits of the said respective premises and all such damages as she my said wife or her assigns shall then have had or sustained by reason of the nonpayment of the said respective annuitys shall be fully satisfied and paid such possession when taken to be without impeachment of waste and as to for and concerning my said freehold messuage or tenement lands hereditaments and premises with the appurtenances in the parish of Chipping Lambourne aforesaid now in the occupation of Richard Creven(?) and also my freehold messuage or tenement with the lands hereditaments and premises thereto belonging situate and being in Newtown in the parish of Hungerford aforesaid commonly called Babers and now in the occupation of Mr John Dibley(?) subject to and charged and chargeable with the payment of the said annuity or yearly rent charge of twenty pounds which my will is shall be clear of all taxes and deduction whatsoever and the remedies and powers hereby given and provided for securing and recovering the same I do give devise and bequeath the same and every part thereof unto my said son Francis Lovelock his heirs and assigns for ever and as for and concerning my freehold messuages lands tenements tythes hereditaments and all my real estate whatsoever situate arising or being in Hidden and Newtown aforesaid and in West Shefford in the said county of Berks or elsewhere not herein before devised to my said son Francis with then and every of their rights members and appurtenances charged and chargeable with the payment of the annuity or yearly rent charge of forty pounds clear of all taxes and reductions whatsoever and the remedies and powers hereby provided and given for securing and recovering that annuity and without prejudice thereto I do give devise and bequeath the same and every part thereof unto my said son Edward Lovelock his heirs and assigns for ever upon condition _______ that he and they do and shall permit and suffer my said wife Ann Lovelock to hold and enjoy ___ and for her own use during her natural life such convenient pat of the messuage or tenement wherein I now reside with such outhouses and conveniences to the same and so much and such part of my household goods furniture plate linnen china liquors utensils and implements of household therein as she shall make choice of or think proper to have and enjoy for her life and I do give and bequeath the use and enjoyment thereof to her accordingly and I do also give and bequeath all my said household goods and furniture plate linnen china utensils and implements of household subject to the use and enjoyment of part thereof by my said wife as aforesaid unto my said son Edward Lovelock to and for his own use and benefit. Also I give and bequeath to my said son Francis Lovelock all my State Term of years and futerest(?) yet to come and unexpired of and in the messuage or tenement farm lands and premisses by me rented or holden Sir William Sonds Baronet situate at Avington in the county of Berks together with the lease thereof and all benefit and advantage to be had or taken thereby subject nevertheless to the rent covenants and agreements therein reserved and contained and which from and after my decease shall grow due on the tenants part to be paid done and performed. Also I give to my said son Francis Lovelock all my household goods and furniture plate linnen china utensils and impliments of household which at the time of my decease shall be remaining and being in and about the said messuage tenement farm house at Avington aforesaid and the Brewhouse and offices thereto belonging. Also I give to my said son Edward Lovelock all that my leasehold estate called Shorts in the parish of Rinchency(?) in the said county of Berks which I hold under the said Sir William Ignes(?) and also my leasehold estate called the Bowling Green situate in Newtown aforesaid which I hold under Richard Garrard Esquire and all my renewable and other Estates Terms and interests in the same estates respectively together with the respective leases which I hold the same and all benefit and advantage to be had or taken thereby also I give to my said son Edward Lovelock all my Estate Term of years and interest yet to come and unexpired of and in the messuage or tenement farm and lands by me rented or holden of the said Sir William Jones(?) called Radney Farm together with the lease thereof and all benefit and advantage to be had or taken thereby subject nevertheless to the rent covenants and agreements therein reserved and contained and which from and after my decease shall grow due on the tenants part to be paid done and performed and al other my leasehold estates in Newtown in the parish of Hungerford aforesaid and as for and concerning all and singular my stock in husbandry corn ___ hay horses sheep cattle waggons ploughs harrows and the harness tackle and _eele thereof or thereunto belonging and all other my stock in husbandry whatsoever situate and being in and upon or about my messuages or tenements farms lands and premises in Newtown Radley and Avington aforesaid and all other my stock in husbandry goods chattles moneys(?) securities for moneys personal estate and ___ whatsoever and wheresoever after and subject to the payment of my just debts funds ____ testamentary charges and expenses and the several legacies aforesaid I give and bequeath the same and every part thereof unto my said two sons Edward Lovelock and Francis Lovelock ____ between them share and share alike and I do hereby consitute and appoint my said sons Edward Lovelock and Francis Lovelock joint executors of this my will and revoking all former and other wills by me at any time heretofore made do publish and declare this to be my last will and testament. In witness whereof I the said Edward Lovelock the testator have to this my will contained in four sheets of paper set my hand and seal to wit my hand to the bottom of the three preceeding sheets of paper and my hand and seal to this last sheet this twenty ninth day of April in the year of our Lord one thousand seven hundred and eighty - Edward Lovelock.

The writing contained in this and the three preceeding sheets of paper were signed sealed published and declared by the said Edward Lovelock the Testator as and for his last will and testament in the presence of us who in his presence at his request and in the presence ____ then have hereunto subscribed our names as witnesses the interlineation between the eleventh and twelfth lines from the bottom of the second sheet between the thirteenth and fourteenth lines from the botton of the same sheet and the two interlineations between the third and fourth lines from the bottom of the same ___ sheet being first severally made and inserted.- William Divands, William Wells Servants to Mr Lovelock, N(?) This will was proved at London the twenty sixth day of October in the year of our Lord one thousand seven hundred and eighty before the Right Worshipful Peter Calvert Doctor of Laws Master or Commissary of the prerogative Court of Canterbury lawfully constituted by the oaths of Edward Lovelock and Francis Lovelock the sons of the deceased and the executors named in the said will to whom administration of all and singular the goods chattells and credits of the said deceased was granted they having been first sworn by commission duly to administer.

Elizabeth Lovelock 1786

This is the last will and testament of one Elizabeth Lovelock of Avington in the county of Berks spinster made this seventeenth day of September in the year of our Lord one thousand (seven) hundred and eighty five as follows: that is to say my will and desire is that all my just debts funeral and testamentary expenses may be duly paid and satisfied as soon after my decease as conveniently may be. Then I give to my niece Eliza Ann Butler all my wearing apparel rings and personal ornaments whatsoever to and for her use and benefit. Also I give to my brother Edward Lovelock the sum of one hundred pounds and to my sister the said Ann Butler the sum of four hundred and fifty pounds to be paid to them respectively within six calendar months next after my decease and as to all the rest and residue of my moneys and securities for money goods chattels and personal estate and effects whatsoever and wheresoever after and subject to the payment of my debts funeral and testamentary expenses and the legacies and bequests aforesaid I give and bequeath the same and every part thereof and all my estate and interest therein unto my youngest brother Francis Lovelock to and for his own use and benefit and disposal and I do make constitute and appoint my said youngest brother Francis Lovelock the executor of this my will. Lastly I revoke all former and other wills by me before made and do publish and declare this to be my last will and testament. In witness whereof I the said Elizabeth Lovelock the testatrix have hereunto set my hand and seal the day and year first above written, Elizabeth Lovelock. Signed sealed and published and declared by the said Elizabeth Lovelock the testatrix as and for her last will and testament in the presence of us who in her presence at her request and in the presence of each other have hereunto subscribed our names as witnesses thereto - William Cunnard(?) of Imit___(?) wheelwright, P. This will was proved at London the twentieth day of February in the year of our Lord one thousand seven hundred and eighty six before the worshipful George Harris Doctor of Laws Surrogate of the right worshipful Peter Calvert Doctor of Laws Master Keeper or Commisary of the Prerogative Court of Canterbury lawfully constituted by the oath of Francis Lovelock the brother of the deceased and the executor named in the said will to whom administration of all and singular the goods chattells and credits of the said deceased was granted he having been first sworn duly to administer.

Elizabeth Marshall Lovelock 1764

In the name of God Amen. Elizabeth Marshall Lovelock of Devonshire Street in the parish of St George the Martyr Bloomsbury in the County of Middlesex Do make this my last will and testament in manner following. I do appoint Benjamin Dod of the parish of Saint Martin Ludgate in the City of London bookseller my sole executor. I desire to be buried in the parish church of Wethersfield in the County of Essex as near the remains of my dear father and mother as may be and that my funeral may be as __ as is consistent with decency and care to my sister Mary Alleyn to the Revd Mr Henry Chalmer and Arabella his wife to Mr Henry Winter and his wife to Mr Francis Smith of Chelmsford in Essex Croner to Mr Benjamin Dod and his wife each of those eight persons one guinea to buy them a ring to give to Susanna the widow of the late Mr Francis Bradshaw bookseller and _ahoner(?) of Rotterdam. Ten pounds sterling I give to Mrs Mary D'Oyley widow late of Drake Street near Redlyon Square four guineas I give to Ann Bradshaw daughter of the said Francis Bradshaw of Roterdam deceased by Susanna his wife the best part of my wearing apparel and household linnen my executor to be chid__(?) the ___ and to allot such part the rest of my said wearing apparel and household linnen not all ___ to the said Ann Bradshaw to be disposed of as my Executor shall direct. I give and bequeath all the rest and residue of my personal estate equally amongst Francis Ann and John children of the said Francis Bradshaw by Susanna his wife their respective executors and ___ share and share alike and it is my will and meaning that no part of the sum of sixty pounds or the interest thereof mentioned in a certain article of agreement. Dated the sixteenth day of November one thousand seven hundred forty fine now in the hands of Mr Benjamin Dodd. Shall be anyways affected by this my will but the same shall notwithstanding beconies(?) the property of the person named therein in manner therein mentioned. And in case either of the said three children of Francis Bradshaw shall be under the age of twenty one years at the time of my decease I do direct my Executor notwithstanding to make payment of their respective shares of the said residue and so declare their receipt for the same to be a sufficient discharge to my said executor and it is my will that my executor shall reimburse himself all charges and expenses which he may be put to by acting as my executor. I desire this may be taken as a codicil to my last will and testament which I made some ten weeks ago. I give to my dear neice Arabella Chalmers wife of the Revd Mr Chalmers my white satin gown a pink coloured silk quilted petticoat and a long black velvet scarf. I also give to the said Arabella Chalmers a small red leather trunk with all that shall be contained in it at the time of my death. Eliz. Lovelock.

On which day appeared personally Benjamin Dod of the parish of Saint Martin Ludgate London bookseller and being sworn on the holy evangelists to depose the truth depard(?) that Elizabeth Marshall Lovelock formerly of the parish of Saint George Bloomsbury in the county of Middlesex but in the parish of Saint Botolph Aldersgate London widow died made her last will and testament in writing hereunto annexed bearing date the tenth day of January one thousand seven hundred and sixty one and on the twenty first of March next following made a codicle to her said will also hereunto annexed and further deposed that Arabella Chalmers the neice of the said deceased and wife of the Reverand Mr ______ Chalmers mentioned in the said codicle died on the fifteenth day of December one thousand seven hundred and sixty two and the said testatrix in the month of January one thousand seven hundred and sixty four. Benj. Dodd. Same day the said Benjamin Dodd was duly sworn to the tenth of this affidavit before me Arthur Collier surrogate present Wm Taverner __.

In the name of God Amen. I John Lovelock mariner now belonging to his Majesty's ship Hampshire lying at Sheerness(?) and late of the parish of Saint Sepulchre within London being in good health and of sound and disposing mind and memory thanks be given to Mighty God for the same but considering the uncertainty of this transitory life and danger of the sea and to prevent any disputes and controversys that may happen after my decease do hereby make my last will and testament in manner following (that is to say) First and principally I recommend my soul unto the hands of Almighty God my creator with hopes of a full pardon and remission of my sins and to be saved by the precious death and merits of my blessed Saviour and Redeemer Christ Jesus and my body to the earth. And as touching and concerning my worldly estates and goods which it hath pleased God to bless me withall I give and bequeath as followeth that is to say I give devise and bequeath all such sum and sums of money lands tenements goods chattels and estates whatsoever ____ personal wherewith at the time of my decease I shall be possessed or invested or which shall then belong or of right appertain unto me I do give devise and bequeath unto Robert Grisewood of the parish of Saint Sepulchre within aforesaid victualler and his heirs executors administrators and assigns. To the only proper use and behoof of him the said Robert Grisewood his heirs executors administrators and assigns for ever. And I do hereby nominate and appoint the said Robert Grisewood sole executor of this my last will and testament. And so hereby revoke all former wills and deeds of gift by me at any time heretofor made and do declare and ordain these presents to stand and be for and ass___(?) last will and testament. Mary Lovelock 1778

In the name of God Amen. I Mary Lovelock of Langdon(?) Hills in the county of Essex widow being of sound and perfect mind memory and understanding praise be to God the ____ do make this my last will and testament in manner following. First I direct that all my just debts be duly paid and satisfied Then I give and bequeath to my nephews Thomas and John(?) Rigglesworth(?) sons(?) of my brother Thomas Rigglesworth the sum of fifty pounds apeice to be paid to them at the expiration of one year next after my decease. Next I give and bequeath to my niece Roberta Little daughter of my said brother Thomas the sum of twenty six pounds to be paid her at the expiration of three months next after my decease. And I ___ that the same be paid into her own proper hands and that her receipt and her receipt only shall be a proper discharge for the same notwithstanding her __ture(?). Also I give and bequeath to Susannah another daughter of my said brother Thomas the sum of forty pounds to be paid her at her attainment of the age of twenty one years. Also I give and bequeath to my nephew John Martin the sum of fifty pounds of lawful money to be paid him at the expiration of one year next after my decease. And as to all the rest residue and remainder of my goods chattels money(?) effects and personal estate whatsoever and wheresoever (after payment of my just debts legacies funeral charges charge of the probate of this my will and other incidelit(?) charges) I give and bequeath the same and every part thereof to my brother Benjamin Rigglesworth. And I do hereby nominate constitute and appoint my said brother Benjamin Rigglesworth and my friend Mr Robert Mabbs of Mountnessing Executors of this my last will and testament and revoking all former and other will and wills by me at any time heretofor made I do publish and declare this to be my last. Nathaniel Lovelock 1756

This is the last will and testament of me Nathanael Lovelock of the parish of Aveley alias Alvethley(?) in the county of Essex farmer first and principally I hereby nominate and appoint my dear friend William Aylot of Stifford sole executor of this my last will and testament and as touching all that personal estate wherewith it hath pleased God to bless me I give to and dispose the same in manner following (that is to say) I give to my sister now Catherine Legg the sum of twenty pounds to be paid her for her sole use and behoof that(?) all at once but in such proportions as shall seem good and right to my said executor to answer her pressing necessities. But it is my will and mind that her husband shall have no benefit nor any claim or demand on my said executor for any part or partes thereof. I give likewise to my brother Thomas Lovelock the sum of ten pounds. I likewise give to my sister Mary Compton the sum of five pounds but if she happens to die before me then I give the said sum to her daughter Mary Izzou. I also give to my sister Elizebeth Titcome the sum of five pounds. I also give to John and Edward Sly the sum of five pounds to be equally divided betwixt them. I also give to Lidia Pike the sum of ten pounds. I also give to Sarah Osman the sum of five pounds if she survives me if not then I give the said sum to her father John Osman. I give likewise to Hannah Wells the sum of ten pounds. I also give to Simon Pike my silver watch and two suits of apparel. The rest of my cloaths I hereby will and require shall be given to my said brother Thomas Lovelock and all the wearing apparel both linnen and woollen which were my late wife Elisebeths I give and bequeath to her sisters Mary Bray and Anne Lygate to be divided equally betwixt them. I further will and require that my said executor pay to Mary my second wife the sum of two hundred pounds for the security and payment whereof I gave a bond before marriage. I also will and require that he pay her the further sum of forty shillings yearly and every year so long as she continues my widow and no longer. All these legacies I will and require be paid to the abovenamed persons out of all my said personal effects within twelve months after my decease by my executor above mentioned. And all the residue and remainder of my said personal estate whatsoever and wheresoever after the said legacies and my lawfull debts are fully paid and discharged I give and bequeath to my said executor William Aylot and to Elisebeth Spencer my beloved niece share and share alike . In the name of God Amen: I Noah Lovelock of Grainge Farm in the parish of Shaw in the county of Berks yeoman being by the goodness of God of sound and disposing mind and memory do make and ordain this my last will and testament in form following (that is to say) my will and desire is that all my just debts funeral and testamentary charges and expences be in the first place duly paid and satisfied then I give unto my beloved brother Thomas Lovelock of the parish of Burghclere yeoman the sum of one hundred pounds in twelve months next after my decease. Also I give to my said brother Thomas Lovelock all and singular my wearing apparel of what nature kind and sort so ever. Item I give to my nephew John Awbrey and to my niece Mary now the wife of ___ Adnams son and daughter of Richard Awbrey by my sister Elizabeth the sum of fifty pounds apiece to be paid them respectively on twelve months next after my decease. Item I give to my nephew Gabriel Machin and niece Mary wife of John Wallen of the parish of Thatcham in the county of Berks blacksmith son and daughter of my late sister Hannah deceased the sum of fifty pounds apiece to be paid them respectively in twelve months next after my decease. Also I give unto my niece Elizabeth wife of Thomas Spicer of Burghclere aforesaid yeoman the sum of fifty pounds to be paid her in twelve months next after my decease. Also I do hereby direct my executor hereinafter named to pay my nephew John Lovelock the principal sum of one hundred and fifty pounds vested in my hands as guardian or trustee for him the said John Lovelock and my will is that my said nephew in regard I have kept him and found him in cloaths without charging any thing therefore shall not be intitled to demand any interest for the said principal sum of one hundred and fifty pounds and my will also is that my executor hereinafter named shall not be intitled to charge my said nephew with any sum of money for such his board or necessaries or be at liberty to deduct any thing out of the above mentioned legacy or trust money for the same unless my said nephew shall set up or make any demand of interest for the principal sum of one hundred and fifty pounds vested in my hands for his use as aforesaid. Item I give to my nephew John Rogers son of my sister Mary late wife of John Rogers deceased fifty pounds in twelve months next after my decease. Item I give to my sister Katherine wife of Thomas New for and during the term of her natural life to be paid into her own hands and for her own sole and seperate use and benefit and so as not to be subject or liable to any debt order or appointment of her husband three shillings and six pence per week to be paid her on Saturday in every week from the day of my decease during the term of her natural life the first payment thereof to begin and to be made on Saturday next after my decease and I do hereby direct and require my executor hereafter named to pay the same accordingly and I do hereby expressly charge the payment of the same upon by and out of the personal estate given to my executor hereinafter named and my will is that in case my said sister Katherine New shall happen to dye within two years next after my decease that my executor hereinafter named shall pay unto Thomas and Mary New son and daughter of my said sister Katherine the sum of ten pounds apiece within six months next after such the decease of my said sister Katherine dying as aforesaid. Lastly all the rest residue and remainder of my goods chattels moneys securities for moneys and personal estate whatsoever and wheresoever and of what nature kind or sort soever I give unto my brother Gabriel Lovelock whom I make full and sole executor of this my will and I hereby revoke and make void all other wills by me at any time heretofore made and so publish and declare these presents only to be my true and last will and testament in witness whereof I have hereunto set my hand and seal the seventh day of October in the year of our Lord one thousand seven hundred and fifty six. the mark of Noah Lovelock. Thomas Lovelock, 1839

This is the last will and Testament of me Thomas Lovelock of Compton Basset in the County of Wilts Gardener made this seventh day of December in the year of our Lord one thousand eight hundred and thirty eight first my will is and I do hereby order and direct that all my just debts funeral expenses and the costs of proving this my will be paid and discharged by my Executors hereinafter named and after payment thereof then I give and bequeath unto my dear wife Bridget Lovelock all the Rest Residue and xxx Remainder of my Estate and Effects of what nature kind or quality the same may be and consist of and wheresoever all my said residuary estate and Effects in manner hereinafter mentioned (that is to say) I give and bequeath to my niece Jane Lovelock, daughter of my brother Jacob Lovelock the interest of the sum of three hundred pounds to be paid to her half yearly by my Executors hereinafter named during the term of her natural life and in case my said niece Jane Lovelock should marry and have children living at the time of her decease then I give the said principal sum of three hundred pounds unto and equally amongst all her children as soon as they shall attain the age of twenty one years But should my said niece Jane Lovelock die without having any lawful issue living at the time of her decease then I give and bequeath the said sum of three hundred pounds unto and equally amongst all my brothers and sisters who may be then living or the lawful issue of such of them as may be dead Also I give and bequeath to my said niece Jane Lovelock my best bedstead bed bedding and the print curtains and furniture thereunto belonging I give and bequeath to my brother Stephen Lovelock the interest of the sum of four hundred pounds to be paid to him half yearly by my Executors hereinafter named during the term of his natural life and from and immediately after his decease then I give and bequeath the said interest to be paid half yearly to his wife (whose Christian name I do not know) should she be then living during the term of her natural life and after the decease of the survivor of them I give and bequeath to my said niece Jane Lovelock daughter of my said brother Stephen Lovelock the sum of three hundred pounds part of the said sum of four hundred pounds and if she die leaving children then the said sum of three hundred pounds to be divided equally amongst them as soon as they shall severally attain their respective ages of twenty one years the interest in the meantime to be paid and applied towards their maintenance and support but should there be no children then the said sum of three hundred pounds to be equally divided amongst all my brothers and sisters or the children of such of them as may be dead I give and bequeath the sum of one hundred pounds (being the remainder of the said sum of four hundred pounds) unto and equally amongst the children of my brother George Lovelock to be paid to them so soon as they shall respectively  attain the age of twenty one years the interest thereof in the meantime to be paid an applied towards their maintenance and support I give and bequeath to my nephews and nieces (the children of my late Sister Jane Cottire) the sum of one hundred pounds to be paid to them as soon as they respectively shall attain the age of twenty one years and to be equally divided amongst them share and share alike the interest thereof in the meantime to  be paid an applied towards their maintenance and support I give and bequeath to my brother Daniel Lovelock the interest of the sum of three hundred pounds to be paid to him half yearly by my Executors hereinafter named during the term of his natural life and from and immediately after his decease then I give and bequeath the interest of the said three hundred pounds unto his wife …… Lovelock (if she shall be then living during her life and from and immediately after the decease of the survivor of them the said Daniel Lovelock and …. His wife then I give and bequeath the said principal sum of three hundred pounds unto and equally amongst all the children of my said brother Daniel Lovelock or such of them as may be then living to be paid to them as soon as they shall severally attain the age of twenty one years and the interest thereof in the meantime to be paid an applied towards their maintenance and support I give and bequeath to Mrs Arabella Baily wife of Mr Edwin Baily of Calne aforesaid Stationer the sum of Eighty pounds to and for her own proper use and benefit and her receipt for the same notwithstanding her coverture to be deemed a good and sufficient discharge for the same I give and bequeath to the said Arabella Baily the following furniture and other articles hereinafter mentioned  that is to say my six best bedroom chairs the oak chest of drawers in my bedroom the large looking glass in the kitchen the tea Chest and Caddy and the Satin picture over the sitting room Chimney piece and one of the prints of the Lord’s prayer the tea pot and china on the chimney piece in the said sitting room and also my silver watch I give and bequeath to Miss Cecil Hill the sum of forty pounds to be paid to her by my Executors hereinafter named within six months next after my wife’s decease Also I give and bequeath to the said Cecil Hill my best set of china and mahogany tea tray six best silver tea spoons and silver sugar tongs watch I give and bequeath to ?? White the son of Mr. George White of Compton Basset aforesaid the sum of fifty pounds to be paid to him by my executors hereinafter named within six months next after my wife’s decease Also I give and bequeath to the said Henry(?) White my best Ivory handle knives and forks I give and bequeath to Mary Ann Scrubbles (late laundry maid to Mrs Hardage(?)  I give and bequeath to my said brother Daniel Lovelock my two silver table spoons and all my wearing apparel watch I give and bequeath to my nephew Thomas Lovelock (son of my said brother George Lovelock) my clock and six common silver tea spoons watch I give and bequeath to Ann Bush (servant to Mrs Hardage(?)  my round mahogany tea table I give and bequeath all the Rest Residue and Remainder of my money and securities for money household goods and furniture all other my Estate and Effects that may remain undisposed of by me and which might belong to me at the time of my said wife’s decease unto my brother George Lovelock to and for his own absolute use and benefit should he be then living at the time of my said wife’s decease but should he happen then not to be living then I give and bequeath all such the aforesaid residue and remainder of my said Estate and Effects unto and equally amongst all the children of my said brother George Lovelock who may be then living  and to be paid to them by my Executors hereinafter named on their respectively attaining the age of twenty one years and the interest thereof in the meantime to be paid an applied by my Executors hereinafter named towards their maintenance and support But my will and meaning is and I do hereby desire it to be distinctly understood that none of the said legatees hereinbefore by me given shall be paid or delivered to any of the said legatees until six months next after my said wife’s decease unless my Executors shall find it convenient to pay or deliver the same to any or ether of the said legatees within a less period after my said wife’s decease in which case they are at liberty so to do And it is my Will and I hereby particularly request my Executors hereinafter named to have a brick grave made with head and foot stone thereto erected I give and bequeath to Joseph Sparkman of the Frith farm in the said parish of Compton Basset and George White of Compton Basset aforesaid carpenter the sum of ten pounds apiece which I beg their acceptance of as a small recompensation for the trouble they may have in the execution of this my Will and I do hereby nominate constitute and appoint the said Joseph Sparkman and George White as joint Executors of this my Will and I do hereby declare it to be my  Will that my said Executors and the survivor of them shall and may at all times in the first place reimburse and indemnify themselves and himself respectively and deduct and retain to themselves and himself respectively out of the monies that may come into their hands all such costs charges damages and expenses as they or either of them shall or may at any time expend lay out or be put into the execution of this my Will and that neither of my said Executors shall be answerable or accountable for any loss which may happen to any of the monies unless such loss shall happen through their or either of their wilful neglect or default nor the one for the other of them nor for any more monies than shall actually come into each of their hands and lastly revoking and making void all former and other wills by me at any time heretofore made I do declare this to be and contain my true last Will and Testament In Witness whereof I have to this my last Will and Testament contained in three sheets of paper set my hand to the first two sheets thereof  and my hand and seal to this third and last sheet thereof the day and year first before written – The Mark X and Seal of Thomas Lovelock signed sealed published and declared by the said Thomas Lovelock Testator as and for this last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses Thomas Williams -  Benjamin Lawrance

APPEARED PERSONALLY Thomas Williams of Compton Basset in the county of Wilts Sawyer and John Ladd of Calne ??? in the said county of Wilts and first he said Thomas Williams for himself saith that he is one of the subscribed witnesses to the codicil to the last Will and Testament of Thomas Lovelock late of Compton Basset in the county of Wilts Gardener deceased the said Codicil bearing date the fourteenth day of December one thousand eight hundred and thirty eight and now hereunto annexed and he further made oath that on the fourteenth day of December aforesaid the said Testator duly executed the said Codicil by making his mark thereto in the presence of this deponent and Benjamin Lawrance the other subscribed witness thereto both of whom were present at the same time and this deponent and the said Benjamin Lawrance thereupon attested and subscribed the said Codicil in the presence of the said Testator and the said John Ladd for himself saith that he is the writer of the paper writing hereunto annexed purporting to be and contain the last Will and Testament of the said Deceased the same bearing date the seventh day of December one thousand eight hundred and thirty eight and this deponent having perused the said Will but more particularly the words “half yearly” appearing interlined between the tenth and eleventh lines of the first page of the said Will saith that the said interlineations was made by him and with the knowledge and approbation of the deceased and previous to the execution of the will – Thomas WilliamsJn. John Lovelock, 1848

This is the Will of John Lovelock of Watlington in the County if Oxford Maltster I give all my freehold (crossed out) real estate unto the use (crossed out) to such uses as my daughter Ann shall from time to time by any deed or deeds appoint and in default of appointment to the use of her heirs and assigns for ever. And I give unto her absolutely all my personal estate and I hereby appoint her Executrix of this my Will and I do hereby revoke all other wills by me at any time heretofore made In witness whereof I have hereunto set my hand this eighth day of December one thousand eight hundred and forty seven – John Lovelock. Signed by the said John Lovelock the Testator who at his request in his presence and the joint presence of us have hereunto our names as witnesses the words ‘freehold’ and ‘unto the use’ in the second line having been erased – Geo Eyre Sol: Benson Oxon – W.G. Appeared Personally George Eyre of Benson in the County of Oxfordshire Solicitor and referring to the last Will and Testament of the said John Lovelock late of Watlington in the county of Oxford Maltster deceased the said will being now hereunto annexed bearing date the eighth day of December one thousand eight hundred and forty seven made oath that on the said day the said Testator duly executed his said will by signing his name at the end there of in the joint presence of this deponent and of William Godfrey Spyer the other subscribed the said will as witnesses of the one execution thereof in the presence of the said Testator – George Eyre – On the 15th day of June 1848 the said George Eyre was duly sworn to the truth of this Affadavit by virtue of the annexed commission Before me John Teallope Rector of Crowmarsh Gifford  in the county of Oxford _____.  

Proved at London the 22nd June 1848 before the Judge by the oath of Ann Lovelock spinster the daughter the sole Executrix whom adm(inistrat)ion was granted having been first sworn by Com(missi)on duly to administer.
